Abstract

States seek, through their public infrastructure and economic policies, to achieve a range of economic objectives, represented in meeting the needs of community members for various goods and services, particularly after the economic and social life advancement. It has become necessary for the state to perform some service functions, and there is a need for state supervision and performance of some tasks that individuals cannot perform due to their linkage to the public system, the stability of transactions, and boosting trust in the trading of deeds and legal transactions. The notary, one of the dominions of the Ministry of Justice in Iraq, play a significant role in public life in society through organizing and documenting the legal transactions that individuals or contractors intend to conclude. These transactions are of great importance due to their connection to personal and financial rights, and this importance comes from the dual trust placed in the notary by the state and individuals together. Providing this service to individuals is in exchange for certain fees determined by special laws that the obligated person is required to pay in return for the service provided by these offices, which are indispensable for the proper functioning of the public system, so that it has motivated individuals to benefit from this service in organizing and documenting their transactions to become official documents that cannot be challenged except by forgery, which has contributed to the stability of financial and contractual transactions in society and the preservation of the public system, and reduced the number of lawsuits brought before the courts.
